1. Scope

These Terms and Conditions apply to all bookings of the holiday apartment Seensucht (hereinafter referred to as the “Accommodation”) between the guest and the landlady:

2. Booking and Contract Formation

Bookings may be made via the website (Smoobu), by email, or through other communication channels. A rental agreement is concluded once:

• the guest has made a binding booking;
• and the landlady has issued a written booking confirmation (by email).

By making a booking, the guest confirms that they have read and accepted these Terms and Conditions.

3. Right of Withdrawal

In accordance with Section 312g(2) No. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for bookings of holiday accommodation for a specific period. The cancellation policy set out in Clause 8 shall apply exclusively.

4. Prices and Payment

Terms All prices are stated in euros per stay or per night, unless otherwise specified. Services included in the rental price are listed in the booking overview. Payment must be made in full at the time of booking (advance payment) using the payment methods provided on the website (e.g. Stripe). A booking is only considered confirmed once full payment has been received. In the event of non-payment, the landlady reserves the right to cancel the booking.

5. Arrival and Departure

• Check-in: from 15:00
• Check-out: by 11:00

Alternative times may be arranged in advance, subject to availability. In the event of a late check-out without prior agreement, the landlady reserves the right to charge for an additional night.

6. Use of the Accommodation

The Accommodation may only be used by the number of persons specified in the booking. Exceeding the maximum occupancy is not permitted and entitles the landlady to terminate the contract immediately without refund. The following are not permitted:

• Parties, celebrations or events of any kind
• Smoking inside the Accommodation (smoking is only permitted outdoors)
• Pets (unless expressly agreed in writing in individual cases)
• Commercial use of the Accommodation

The guest is obliged to treat the Accommodation and its contents with care and to leave it in a tidy condition upon departure. Final cleaning is included in the rental price unless otherwise stated.

7. Damages

The guest is liable for any damage caused to the Accommodation, its contents, or communal areas during their stay. Any damage must be reported immediately and during the stay. The landlady reserves the right to claim compensation after departure if damage is only identified during the final inspection.

8. Cancellation Policy

Cancellations must be made in writing (by email) to the landlady. The relevant date is the date of receipt of the cancellation notice. The following conditions apply:

• Cancellation 14 days or more before arrival: full refund of the rental price
• Cancellation 7 to 13 days before arrival: 50% of the total price retained, 50% refunded
• Cancellation less than 7 days before arrival: 100% of the total price retained, no refund
• No-show without prior cancellation: 100% of the total price retained, no refund
• Early departure: no entitlement to a partial refund

The guest may provide evidence that the landlady has incurred lower damages. The landlady recommends taking out travel cancellation insurance.

9. Force Majeure

In the event of force majeure (e.g. natural disasters, official orders, pandemic measures) that makes use of the Accommodation impossible, both parties have the right to withdraw from the contract. In such cases, any rental payments already made will be refunded in full. Further claims for damages are excluded.

10. Liability of the Landlady

The landlady shall only be liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law. No liability is accepted for guests’ personal belongings. Guests are advised to keep valuables secure.

11. Data Protection

The processing of the guest’s personal data is carried out solely for the purpose of performing the rental agreement and in accordance with the applicable privacy policy available on our website.

12. Final Provisions

German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from this contractual relationship shall, where legally permissible, be the registered address of the landlady (Nohfelden, Saarland). Should any provision of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.
